Terms of Service

1. Acceptance of Terms

By creating an account, generating API keys, creating payment links, or accessing any service provided by FamGateway, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the platform.

2. Nature of Software Services (Non-Custodial Architecture)

You explicitly acknowledge and understand that:

• Zero Custody / We Don't Hold Your Money: FamGateway does not collect, hold, process, or escrow a single penny of your fiat money or customer funds.
• Direct Peer-to-Peer Settlement: When a customer scans a dynamic QR code or pays via a FamGateway payment link, the transaction is executed directly between the customer's bank/UPI app and your personal FamPay/UPI account.
• Stateless Verification: FamGateway operates strictly as a software notification and verification layer via stateless IMAP transaction parsing and automated webhook delivery.

3. Merchant Account Responsibilities

As a registered user or merchant on FamGateway, you agree to:

1. Provide accurate contact and account details during registration.
2. Maintain the confidentiality and security of your account credentials and API keys.
3. Use secure, single-purpose Google App Passwords for IMAP receipt verification rather than primary personal passwords.
4. Take full legal responsibility for any products, digital assets, or services you sell using FamGateway payment links or APIs.

4. Prohibited Products & Activities (Zero Tolerance Policy)

You are strictly prohibited from using FamGateway for any illegal, unlawful, or high-risk activities under Indian Law, including but not limited to:

• Phishing, financial scams, deceptive pyramid/Ponzi schemes, or money laundering.
• Unauthorized gambling, betting, or illegal lottery platforms.
• Sale of counterfeit goods, unauthorized copyright infringement, or malicious software (malware/ransomware).
• Any goods or services prohibited under the Information Technology Act, 2000, or Reserve Bank of India (RBI) regulations.

Violation of this policy will result in immediate and permanent account termination, API key revocation, and potential reporting to law enforcement authorities.

5. Service Fees & 0% Commission Policy

FamGateway provides its core payment automation software with 0% transaction fees. Any optional premium addons or enterprise tools are billed transparently as indicated in your dashboard.

6. Limitation of Liability

FamGateway and Aryanispe shall not be held liable for any indirect, incidental, consequential, or punitive damages resulting from:

• Bank-level UPI network downtime, NPCI outages, or email delivery delays by third-party mail providers (such as Google/Gmail).
• Unauthorized access to your account resulting from your failure to secure your API keys or passwords.
• Disputes, refunds, or chargebacks arising between you and your end-customers.

7. Third-Party Trademarks & Disclaimer

All product and company names, including FamPay, FamApp by Trio, UPI, NPCI, Google Pay, PhonePe, and Paytm, are trademarks™ or registered® trademarks of their respective holders. Use of these names on FamGateway is solely for technical compatibility, interoperability, and descriptive purposes and does not imply any affiliation, sponsorship, or endorsement.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal proceedings arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
